再谈996工作制

最近一段时间996工作制受到了各种谴责、口诛笔伐,但是,IT界的大佬们一个个的站出来为996洗白,于是在网络上更多的口诛笔伐,更多的口水,让各种吃光群众愕然。

就其根本原因,在改革开放很多年之后,《劳动法》颁布实施于1994年,其中很多情况《劳动法》已经不能完全涵盖,如对劳动者的定义,什么是劳动者?笔者百度了下,其法律定义为:具体指达到法定年龄,具有劳动能力,以从事某种社会劳动获得收入为主要生活来源,依据法律或合同的规定,在用人单位的管理下从事劳动并获取劳动报酬的自然人(中外自然人)。另外问题来了,用人单位是什么?笔者又百度下,其定义为:“用人单位是指具有用人权利能力和用人行为能力,运用劳动力组织生产劳动,且向劳动者支付工资等劳动报酬的单位。”

马云4月11日对员工们说:“我个人认为,能做996是一种巨大的福气,很多公司、很多人想996都没有机会。所以今天中国BAT这些公司能够996,我认为是我们这些人修来的福报。”刘强东12日发朋友圈说:“京东永远不会强制员工995或者996,但是每一个京东人都必须具备拼搏精神!并谈到,“混日子的人不是我的兄弟!我是要为18万兄弟背后那18万个家庭负责,还是留下那1%混日子的人,我没有选择的余地!” 问题来了,注意,在大多数IT大佬的谈话中,谈论到的,有员工和兄弟,如京东谈论到的是兄弟,马云谈论到的是员工。

大佬言论一出,网络上一片骂声,单也有赞同的,大佬们所说的员工都是上面《劳动法》里面所说的劳动者吗?

答案是否定的,在改革开放进程中,我们国家的劳动关系发生了深层次的变化,从单一的国家雇佣,到法人雇佣,试问下,一个持股的员工还是单纯的劳动者吗?

显然不是,作为企业的股东之一,肯定不再适用《劳动法》的管辖范围,因此,对于这类员工而言,996工作制是非常合理的,强调其奋斗精神也不为过。

对于不是企业合伙人或者持股股东的一般员工而言,适用于《劳动法》与《劳动合同法》的管辖,企业公然要求996本身就是违法,不存在对错的问题,如同公开在大街上杀人越货一样,需要国家根据法律进行强有力的干预,如公开对违法进行审判,对企业违法者按照法律规定进行处罚。

如今我们再来探讨996的时候,西方先进国家在实施弹性工作制、虚拟工作制,开始对社会组织模式进行再次变革,兼顾家庭责任和创新,兼顾短期利益与长期利益,而我们还在对工作时间耿耿于怀,一味的最求增长速度,而忽略员工的长期发展、长期创新能力的提升,当人口红利被侵蚀殆尽之后,增长与创新就成为无源之水,整个国家的发展将真正面临巨大的危机。
